Former "American Idol" contestant Ian Benardo is trying his luck again ... suing the show for discrimination for the third time -- but this time, he's asking for a lot less money.
Benardo has filed this suit twice before -- claiming "Idol" producers "exploited" his sexual orientation by asking him to "gay it up" on their show -- and it was tossed out on a technicality each time.
This time Benardo and his lawyer, Matthew Blit, think they have their ducks in a row and filed the suit again in federal court on Friday.
But get this ... the first time Benardo sued for $300 million, the second time he asked for $100 million, and this time ... he's asking for just $5 million.
If this gets tossed out again, the next lawsuit will be for bus fare.

Roseanne Barr files suit against ex-husband
Don't people know better than to mess with the one and only Roseanne?!
Apparently Roseanne Barr's ex husband, Ben Thomas, didn't get the memo and that landed him with a swift lawsuit slap right in the face!
Here's what happened...
Wait, let's back it up a second first.
Her former hubby of seven years (and also former bodyguard) filed against the comedianne last October for violating the custody agreement of their 15-year-old son, Buck.
The arrangements were made a year earlier, after Barr decided to move to Hawaii and take their son with her. She agreed to fly Thomas and his new wife over for ten days each month, all expenses paid.
But, the plan didn't last long. Thomas quotes one of Barr's emails, which said, "I decided I'm no longer interested in abiding by this ridiculous arrangement" and suggested that if he wanted to see Buck, he could "buy himself a ticket and book a room."
That's why he filed, but that's not exactly what pissed the actress off. It was more so the fact that he's blasting it all over the world for everyone to see, including her email address!
Ergo, Roseanne's lawsuit.
Per the complaint filed yesterday at the Los Angeles County Superior Court and obtained by E! News, the actress stated that when the couple divorced, their "2002 Agreement and Order" authorized intense confidentiality and sealed all documents.
Roseanne added that her ex's October lawsuit, "ignored the confidentiality provision which he was unquestionably bound by, and revealed his self-serving attitude and wanton disregard for Plaintiff's privacy, emotional sanguinity...."

Her lawsuit against Thomas is claiming Intentional Infliction of Emotional Distress, Breach of Contract, Invasion of Privacy and several others.
Maybe he learned his lesson now.

Jaime Pressly Files for Divorce
It's been reported that Jaime Pressly has filed for divorce from her husband of 16 months, Simran Singh.
Earlier this week there were reports that the couple had split. Now RadarOnline.com says the 33-year-old actress cited irreconcilable differences as the cause for the collapse of her marriage which she claims ended on December 27.
On Jan. 5, Pressly was arrested on the suspicion of drunk driving. She was driving in Santa Monica when police pulled her over at around 11 PM for an alleged traffic violation. Following a field sobriety test, she was arrested and booked.
Pressly is asking that the court not award Singh spousal support. Tax records show the IRS has filed for over $500,000 in tax liens against her in the last year, and the state of California is looking to collect $95,080.
The former 'My Name is Earl' star and two-time Emmy nominee has a three-year-old son, Dezi James Calvo, from her previous relationship with DJ Eric Cubiche. She and Singh have no children together.

Stafon Johnson Files Suit Against USC
Former USC running back Stafon Johnson has filed a lawsuit against USC over a weightlifting accident that almost killed him -- claiming his USC weightlifting coach recklessly struck the bench press bar that crushed his neck.
Johnson claims he was bench pressing 275 pounds in the USC weight room in Sept. 2009 -- part of the required football regimen -- when Jamie Yanchar, an assistant strength and conditioning coach for the football team, was "spotting" him.
While Johnson attempted to grasp the bar on his own, Yanchar allegedly struck the bar, knocking it off balance and slipping from Johnson's hands. The bar fell on to his neck causing severe injury and ending his college football career.
According to the suit, filed today in L.A. County Superior Court, Yanchar's "negligent, careless and reckless" action in striking the bar "substantially increased the risk inherent in Mr. Johnson's bench pressing."
Johnson -- who eventually signed with an NFL team -- is suing for unspecified damages including loss of future earnings.
UPDATE: A rep from USC released a statementt saying, "USC firmly believes it was not at fault in Stafon Johnson's unfortunate weightlifting accident. We are sorry that Stafon was injured."
The statement continues, "USC and the entire Trojan Family have been exceptionally supportive of Stafon from the minute the accident occurred. We are disappointed to learn that Stafon has decided to file a lawsuit against USC."
